§ 1 - General provisions

  1. These regulations define the rules for using the online store operated by:
    NLA SYSTEMS Limited Liability Company
    with its registered office in Bydgoszcz, ul. Fordońska 24B, 85-085 Bydgoszcz
    KRS: 0001112242, NIP: 9532804488, REGON: 528969100
    hereinafter referred to as the "Seller".
  2. The store operates at the following addresses: www.nla-systems.com , www.metatronstore.com and on all social media channels, such as Facebook, Instagram, Telegram, where the managing entity is NLA SYSTEMS Spółka z ograniczoną odpowiedzialnością.
  3. The Buyer placing an order accepts these Terms and Conditions. The Buyer has no right to unilaterally amend the provisions of these Terms and Conditions. Any changes must be made in writing, otherwise they are null and void.
  4. The presented content, descriptions, graphics, and documents are protected by copyright. Copying, distribution, or use thereof without the Seller's written consent is prohibited.
  5. The information published on the store's website does not constitute a commercial offer within the meaning of Article 66 of the Civil Code.

§ 2 - Definitions

  1. Buyer – a natural person, legal person or organizational unit making a purchase.
  2. Product – any form of service offered by the Seller, in particular: a movable item, software, training, IT service, consultation, service.
  3. Sales contract – a contract concluded at a distance between the Seller and the Buyer.
  4. Working day – every day from Monday to Friday, excluding public holidays.

§ 3 - Orders

  1. Prices in the store are given in Polish zloty and are gross prices.
  2. The order is placed via the form on the website.
  3. The Seller is not responsible for the Buyer's errors when placing the order.
  4. After placing the order, the Buyer receives an e-mail confirmation.
  5. The Seller reserves the right to cancel the order in the event of unavailability of the goods, without any obligation to provide compensation.

§ 4 - Payment and delivery

  1. Accepted payment methods: bank transfer, electronic payments, cash on delivery (if available).
  2. Shipping costs are included in the price of the Product and are determined on the basis of the lowest prices according to the current price list of Poczta Polska.
  3. In the case of a return shipment, the Buyer is obligated to insure it for the exact same value as the gross price of the returned goods. Failure to meet this requirement may result in the Seller being exempt from liability for damage or loss of the goods.
  4. If the Seller delivers the Product in person to the Buyer, an additional shipping cost of PLN 1.15 per kilometer , round trip, will be charged. This cost is non-refundable in the event of withdrawal from the contract and will be deducted from the refund amount.

§ 5 - Warranty and Liability Exclusions

  1. Products are covered by a 12-month warranty from the date of delivery.
  2. The warranty does not cover consumables such as: lamp, cover, USB cable, case, fuses, headphone cushions, etc.
  3. The warranty becomes invalid in the event of: ◦ any modification of the Product, ◦ interference with the Product by unauthorized persons, ◦ any attempts to repair the Product by unauthorized persons, ◦ tearing off the warranty sticker.
  4. The Seller is not liable for indirect or consequential damages (loss of data, profits, business interruptions).
  5. Pursuant to Article 2, Section 38 of the Act of 20 May 2010 on Medical Devices, the products offered (including METATRON, Plasma Therapy, and Plasma Connect) are not medical devices. They cannot be used for diagnosis or treatment within the meaning of academic medicine.
  6. The seller is not responsible for any side effects resulting from the use of the equipment.
  7. The Buyer uses purchased products at their own risk and in accordance with their own recommendations. The Seller is not liable for any losses incurred by third parties as a result of the Buyer's use of the product.

§ 6 - Withdrawal from the contract and returns

  1. A buyer who is a consumer may withdraw from the contract within 14 days of receiving the product.
  2. Withdrawal must be sent in writing to the Seller's address or by e-mail.
  3. In the event of withdrawal from the contract, the period of use of the product is treated as a rental in the amount of PLN 150 for each commenced day of use beyond the 14th day , counted from the date of receipt of the product by the Buyer.
  4. The travel costs incurred by the Seller are not refundable.
  5. The product must be returned with full equipment and in undamaged condition.

§ 7- Exclusions from the right of withdrawal

The right of withdrawal does not apply in the event of:

  1. conducted software training,
  2. activation of software licenses or personalization,
  3. calibration, installation, configuration of devices, technical advice, service;
  4. Travel costs, which amount to PLN 1.15 per kilometer traveled, round-trip. This amount is charged regardless of the service's performance and is non-refundable, even if the Customer withdraws from the contract. The Customer is not entitled to a refund of travel costs at any stage of the service provision. If a refund is required, the travel costs incurred by the Seller will be deducted from the refundable amount.
  5. equipment rental.
  6. No right of withdrawal – digital software and other digital content. In accordance with applicable law (in particular Directive 2011/83/EU and the Consumer Rights Act), the purchase of software in digital form that is not delivered on a tangible medium is final and non-refundable. By purchasing such software in the NLA-SYSTEMS online store, the customer loses the right to withdraw from the contract, regardless of the time of activation or download. The order is considered binding upon payment.

§ 8 - Complaints

  1. Complaints should be submitted in writing or by email.
  2. If the complaint is accepted, the Seller will repair, replace or refund the money.
  3. Complaints are considered within 14 business days.
  4. In the case of a complaint shipment, the Buyer is obliged to send the shipment with insurance and the markings "handle with care" and "top/bottom".

§ 9 Privacy Policy

  1. The personal data administrator is NLA SYSTEMS Sp. z o. o.
  2. Data is processed in accordance with the GDPR and is not made available to third parties except as required by law.
  3. Details of processing can be found in the Privacy Policy published on the store's website.

§ 10 - Final provisions

  1. In matters not regulated by these regulations, the provisions of the Civil Code and the Consumer Rights Act shall apply.
  2. In the case of unregulated matters that are not directly resolved by the Civil Code, the competent court to hear the dispute is the District Court in Bydgoszcz.
  3. The Regulations are effective from the date of publication and may only be changed by the Seller in writing.
